Terms of Service

These Terms of Service govern your access to and use of BuildKola, a trust and verification platform for remote construction and physical projects operated by TECHKOLA LIMITED (“BuildKola”, “we”, “us”, or “our”). By creating an account, accepting these terms, or using BuildKola, you agree to them.

If you use BuildKola on behalf of an organization or business entity, you confirm that you are authorized to accept these terms for that organization.

1. Eligibility and account responsibility

You must be at least 18 years old and legally able to enter into a binding agreement to use BuildKola. You must provide accurate registration information, keep it current, protect your credentials, and promptly notify us if you suspect unauthorized account access.

You are responsible for all activity under your account. We may require multi-factor authentication (MFA), identity verification, business details, or payout-destination verification before enabling sensitive capabilities.

2. Platform role and verification disclaimer

BuildKola provides a digital workspace, mobile applications, and software tools to facilitate project milestone tracking, evidence collection, photo/video documentation, location metadata capture, independent verification, and organization management for project owners, contractors, builders, artisans, and verifiers.

BuildKola is a trust and software verification platform. We are not a construction firm, bank, lender, insurer, escrow service, or money-transmission network. Financial and identity services are provided by regulated third-party payment and verification providers under their respective terms.

3. Evidence, milestone tracking, and AI assistance

Users may submit milestone updates, progress reports, photos, videos, receipts, and location metadata ("Project Evidence"). You represent that all evidence submitted is truthful, accurate, and unmanipulated.

BuildKola may incorporate automated systems or artificial intelligence ("AI") tools to analyze photos, video streams, documents, or metadata to assist in detecting inconsistencies or preparing verification summaries. You acknowledge that AI analysis is purely assistive: final milestone approvals, verification reports, and payout releases remain the sole responsibility of human users, project owners, or designated verifiers.

4. Organizations and permissions

Organization owners and administrators control user roles, membership, and access permissions. Administrators must assign permissions responsibly and revoke access when no longer required. You must not claim an organization or submit organizational data without proper authority.

5. Acceptable use and prohibited conduct

You must follow our Acceptable Use Policy. You must not submit false milestone evidence, manipulate location metadata, facilitate fraud, misrepresent completion of work, evade platform controls, or violate applicable laws.

6. Fees and third-party payment processors

Applicable BuildKola platform fees are disclosed prior to paid commitments. Payments, bank transfers, and payout resolutions are processed by authorized third-party payment providers. We do not directly store full banking credentials or operate regulated financial accounts.

7. Intellectual property and content licence

BuildKola software, trademarks, and branding are owned by TECHKOLA LIMITED or its licensors. You retain ownership of content and evidence you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, process, transmit, analyze, and display your content solely to operate, protect, and improve the service.

8. Privacy

Our Privacy Policy explains how personal data, evidence uploads, location metadata, and device information are processed. Our Cookie Policy explains website session technologies.

9. Suspension and termination

You may terminate your account at any time. We may restrict, suspend, or terminate access if reasonably necessary to protect users or the service, investigate suspected fraud, address non-payment, or comply with legal requirements.

10. Service disclaimers and limitation of liability

To the maximum extent permitted by law, BuildKola is provided “as is” and “as available” without warranties of any kind. We do not guarantee that milestone verification eliminates all construction risks or guarantees physical build quality.

To the extent permitted by law, TECHKOLA LIMITED is not liable for indirect, incidental, special, or consequential loss, lost profits, or data loss arising out of your use of the service.

11. Centralized governing law and dispute resolution

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any dispute arising out of these terms will be submitted first to informal dispute resolution, and if unresolved, to the competent courts of Nigeria.
